Multnomah County prosecutors announced today they will not pursue criminal charges against Sheriff’s Chief Deputy Tim Moore over allegations he failed to complete the field training for his state police certification.
A memo (PDF) from the DA’s office says Moore did not physically demonstrate some of the knowledge areas as required, but there was no evidence of criminal wrongdoing.
The memo notes the state Department of Public Safety Standards and Training, which certifies cops in Oregon, will now perform its own review of the case.
“There is evidence that Moore did not physically demonstrate all of the knowledge areas in his DPSST manual as required by DPSST, but that fact, standing alone, does not constitute criminal conduct,” writes Senior Deputy DA Don Rees.
“What impact, if any, this may have on Moore’s DPSST certification will be determined by that agency,” Rees continues. “This inquiry is strictly limited to a determination of criminal culpability and based on the facts presented in this evidence, there is none.”
The announcement came one day after WW reported on the investigation and on the same day that Lt. Dan Staton, who was head of training in the sheriff’s office at the time, was sworn in as interim sheriff.
The memo also notes that according to County Attorney Agnes Sowle, Moore was not required to gain his police certification when he moved from corrections to the law-enforcement division at the sheriff’s office. We’re waiting on a call back from DPSST to confirm if that’s true.

The DA’s investigation said that Moore admitted that he only spoke about how to do some tasks instead of actually doing them as required when submitting the documents to the State Department of Public Safety and Standards Training for certification.
DPSST “may deny or revoke the certification of any public safety professional based upon a finding that the public safety professional or instructor falsified any information submitted on the application for certification or on any documents submitted to the Board or Department.”
Posted by BlueOregon 4/27/06 – Willamette Week is reporting on their website that Multnomah County DA Mike Schrunk has asked the state to investigate the allegations that Diane Linn directed a staff member to alter her calendar – an official government record.
“The allegations made by Willamette Week are serious and should be investigated,” Schrunk wrote to Linn. “However, because as the Chair you have a voice in my budget and also because of the allegations you have made against one of my staff…I believe there would be the appearance of a conflict if this office kept the case.”
In reviewing the MCDA’s ZEALOUS concerns for a DOJ investigation, publicly empasizing (for effect?….face red yet?) the seriousness of the allegations, into the legality of a public servant falsifying information, had that particular public servant (the DA’s office acknowledged being at odds with) been found guilty of falsifying public information/records, it would have been a Class A Misdemeanor.
What doesn’t translate to the “issue” that occurred at the Sheriff’s Department?

Physical certification document requirements not met, that a chief deputy requested a supervisor sign-off had been. These documents sound as though they misrepresented that Moore had met the requirements. He admitted he hadn’t met the qualifications.
Mr. Pitkin, please contact the DA’s office for clarification regarding their findings? This is confusing.
Now we know how Bob Skipper claims to have qualified on the firing range under Dan Staton’s instruction.
Following Tim Moore’s methodology, Skipper did not actually hold a pistol and fire a live round into an actual target.
He only discussed with Staton how he would do it.
Hey, maybe Moore and Skipper’s next jobs will be either a brain surgeon or a “double-nought spy.”
